Topamax and Birth Defects

Lawyers for Victims of Birth Defects Caused by Topamax

Topamax, similar to Zoloft or Paxil, is commonly prescribed to treat chronic migraines or seizures. It was originally approved by the Food and Drug Administration (FDA) in 1996 as a category C drug, meaning it had not been found to be either safe or unsafe for pregnant women. Although initial tests on pregnant animals indicated possible problems with birth defects, the manufacturers of Topamax (Ortho-McNeil Neurologics, Teva Pharmaceutical, Watson Pharmaceuticals, Mylan Inc.) chose to ignore these warnings and proceeded with approval.

In July 2008, however, the medical journal Neurology published a study that found that women who take Topamax prior to or during pregnancy are 20 times more likely to have children with birth defects such as cleft lip, cleft palate or genital birth defects. In March 2011, the FDA upgraded Topamax to a category D, indicating that the drug causes known risks to a human fetus.

If your infant suffered serious birth defects as a result of taking Topamax, you may have a claim for damages against the drug manufacturer. The attorneys of Miller Weisbrod, LLP, provide experienced representation in all types of pharmaceutical liability.

We invite you to contact our experienced attorneys today to discuss your case in a free, confidential consultation.

Pursuing Compensation for Topamax Birth Defects

The use of Topamax not only affects pregnant women, but also those of child-bearing years. Pregnant mothers or non-pregnant women who use Topamax are more at risk to have babies with birth defects such as:

  • Cleft lip or cleft palate (craniofacial defects)
  • Genital birth defects such as hypospadias

These defects often require expensive surgery or multiple surgeries to correct. At Miller Weisbrod, we provide skilled representation against negligent pharmaceutical companies, who often use their original FDA approval as a defense against wrong-doing. With significant experienced taking on big drug manufacturers nationwide, we understand how to help you pursue just compensation for resulting medical expenses and the pain and suffering your family has endured.
